Taiwan has exposed another alleged route into China’s restricted AI supply chain, indicting nine people accused of helping divert Nvidia-powered servers.
Prosecutors in Taiwan’s port city of Keelung said Monday that eight defendants were charged with breach of trust and document forgery over the alleged illegal export of high-end AI servers made by Super Micro Computer and equipped with Nvidia chips.
A ninth defendant faces separate allegations involving the diversion of funds from a distributor.
Prosecutors revealed that a total of 130 servers were shipped under the scheme. While Taiwan customs officials intercepted 56 of them due to irregularities, 74 servers successfully reached customers in China. Of those delivered, 50 were routed through Indonesia, eight moved through Japan and Hong Kong, and 16 were shipped directly.
The defendants include an employee of Nvidia’s Taiwan unit, two employees of Super Micro’s Taiwan operation, and executives linked to Taiwanese distributors, Reuters reported. The companies themselves were not charged.
Nvidia said its employees have “every incentive to work diligently with customers to ensure compliance with all applicable laws,” per Reuters. The company also said it would work with Taiwanese authorities to resolve the allegations.
Super Micro said its cooperation with Taiwan authorities led to the arrests of the indicted individuals and stressed that the company “is not a target of their investigation and has not been accused of any wrongdoing.”
How the servers allegedly reached China
The case centers on B300 servers ordered from Super Micro. Prosecutors said false documents made it appear the machines would be installed at a Taiwanese server facility. That did not happen.
In a Reuters report, the prosecutors said the defendants knew Nvidia and Super Micro had “rigorous internal control procedures” for exports and nevertheless “colluded with one another at various levels for enormous profit.”
The alleged scheme comes amid U.S. restrictions, in place since 2022, requiring licenses for exports of advanced AI semiconductors and related systems to China.

The legal exposure is currently focused on individuals, but the broader risk is tougher export enforcement and higher compliance costs for companies selling advanced AI infrastructure.
Taiwanese prosecutors are seeking prison terms of up to five years for seven defendants. The legal exposure currently centers on individuals, while Nvidia and Super Micro have both stressed their cooperation with authorities.
The case adds to wider scrutiny of how advanced AI hardware reaches restricted markets despite export controls. For manufacturers, the harder problem may be what happens after a server leaves the factory: distributors, end-user declarations and cross-border shipping routes can all become part of the compliance chain.
